These Terms & Conditions govern your access to and use of FoodFlick’s website, services, software, and applications. By accessing or using our Services, you agree to be legally bound by these Terms.

Welcome to FoodFlick.app ("FoodFlick", "we", "our", or "us"), an online ordering and restaurant management platform.

These Terms & Conditions ("Terms") govern your access to and use of our website located at https://foodflick.app (the "Site") and all related services, software, mobile applications, APIs, and tools (collectively, the "Services").

By accessing or using our Services, you agree to be legally bound by these Terms.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("Customer", "User", "you", or "your") and FoodFlick.

If you are entering into this agreement on behalf of a company, restaurant, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

If you do not agree with these Terms, you must not access or use the Services.

We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.

2. Description of Services

  • Online ordering system for restaurants
  • Website and digital menu builder
  • Order management dashboard
  • Built-in POS
  • Payment integrations
  • Delivery management tools
  • Mobile app integrations (if applicable)

FoodFlick does not:

  • Handle food delivery
  • Own or operate restaurants
  • Handle food preparation
  • Control food safety
  • Guarantee restaurant compliance
  • Act as a party in transactions between restaurants and their customers

We provide software tools only.

3. License & Permitted Use

Subject to your compliance with these Terms and payment of applicable fees, FoodFlick grants you a limited, non-exclusive, non-transferable, revocable license to use the Services.

You may NOT:

  • Copy, resell, sublicense, or redistribute the software
  • Reverse engineer or attempt to extract source code
  • Modify core software files without authorization
  • Use the system to compete directly with FoodFlick
  • Share login credentials across unauthorized users
  • Remove branding where not permitted by your subscription plan

All intellectual property rights remain the exclusive property of FoodFlick.

4. Account Registration & Responsibilities

To use certain Services, you must create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Be responsible for all activities under your account
  • Notify us immediately of unauthorized access

FoodFlick reserves the right to suspend or terminate accounts that violate these Terms.

5. Customer Content

"Customer Content" means any content uploaded, posted, or displayed by you, including restaurant information, menu items, pricing, images, promotions, legal pages, and customer data.

You are solely responsible for:

  • Accuracy of content
  • Compliance with local laws
  • Ensuring you have rights to use uploaded materials
  • Drafting your own Privacy Policy and Terms (if required)

FoodFlick does not verify the legality or accuracy of Customer Content.

6. Payments, Subscriptions & Billing

Subscription Plans

  • FoodFlick operates on a subscription-based model (monthly or yearly plans).
  • Fees are billed in advance.
  • All fees are non-refundable unless explicitly stated.
  • Taxes may apply based on jurisdiction.

Automatic Renewal

Subscriptions automatically renew unless canceled before the renewal date.

Refund Policy

  • Subscription fees are non-refundable.
  • Custom development work is non-refundable.
  • Setup fees are non-refundable.
  • Third-party fees are non-refundable.

Chargebacks

FoodFlick maintains a zero-tolerance policy for fraudulent chargebacks. Accounts may be permanently suspended if payment disputes are found to be invalid.

7. Custom Work & Modifications

  • Customizations and integrations are not included in standard subscriptions.
  • Custom work is priced separately.
  • Custom work is non-refundable once work begins.
  • Customization does not include bug fixes.

8. Definition of a Bug

A "Bug" is defined as:

  • A feature not functioning as described in official documentation
  • A system error preventing normal intended usage
  • A functionality not operating as demonstrated in our official demo

The following are NOT considered bugs:

  • Design preferences
  • Feature enhancements
  • Workflow adjustments
  • New feature requests
  • Aesthetic changes

9. Third-Party Services

FoodFlick integrates with third-party services including payment processors, app stores, hosting providers, SMS providers, and APIs.

We are not responsible for:

  • Third-party service downtime
  • Third-party pricing changes
  • API modifications
  • External service outages

10. Data & Privacy

FoodFlick processes data in accordance with its Privacy Policy. You are responsible for complying with local data protection laws and obtaining proper customer consent.

11. Limitation of Liability

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. FoodFlick shall not be liable for loss of profits, business interruption, data loss, revenue loss, indirect damages, or restaurant operational losses.

Our total liability shall not exceed the amount paid by you to FoodFlick in the previous three (3) months.

12. Termination

FoodFlick may suspend or terminate your account if you violate these Terms, fail to pay fees, misuse the Services, or engage in fraudulent activity.

Upon termination, access will be revoked and data may be deleted after a reasonable period.

13. Intellectual Property

All trademarks, logos, software code, designs, and branding related to FoodFlick are owned exclusively by FoodFlick.

14. Prohibited Activities

You may not use FoodFlick to violate laws, promote illegal products, upload malicious code, distribute spam, infringe intellectual property, or mislead consumers.

15. Export Compliance

You agree to comply with all applicable export and trade laws.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws where the services are being used. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

17. Disclaimer of Warranties

FoodFlick makes no warranties that Services will be uninterrupted, error-free, or guarantee specific business results.

18. Force Majeure

FoodFlick shall not be liable for failure or delay caused by natural disasters, government restrictions, internet outages, war, or third-party service failures.
